Welcome to BD Card Shop. The terms “we,” “us,” and “our” refer to BD Card Shop. BD Card Shop operates this store and website, including all related information, content, features, tools, products, and services, in order to provide customers with a curated shopping experience.
Our store is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referenced here, describe your rights and responsibilities when you visit, interact with, browse, create an account, place an order, or purchase from BD Card Shop.
Please read these Terms carefully. They include important information about product condition, collectible market volatility, sealed product contents, warranty disclaimers, order cancellation rights, shipping limitations, and limitations of liability.
By visiting, interacting with, using our Services, or placing an order, you agree to be bound by these Terms of Service and our store policies, including our Privacy Policy, Return and Refund Policy, and Shipping Policy. If you do not agree, you should not access our website or use our Services.
SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms, you represent that you are at least the age of majority in your state, province, or place of residence, or that you are the age of majority and have given consent for any minor dependent to use the Services on devices you own, purchase, or manage.
To use the Services, including browsing our store or purchasing products, you may be asked to provide information such as your name, email address, billing address, shipping address, payment information, and other order details.
You represent and warrant that all information you provide is correct, current, and complete, and that you have all rights necessary to provide that information.
You are responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to any other person.
BD Card Shop is not responsible for order issues caused by incorrect customer account information, incorrect shipping addresses, outdated contact information, unauthorized account access caused by customer negligence, or customer failure to update account details.
SECTION 2 - OUR PRODUCTS
BD Card Shop sells physical collectible products, including individual sports trading cards, collectible card game cards, raw cards, graded cards, sealed trading card products, card supplies, memorabilia, player lots, team lots, and related collectibles.
We make reasonable efforts to provide accurate product titles, photos, descriptions, card details, condition notes, pricing, and availability. However, errors, omissions, or differences in opinion can occur.
Colors, card appearance, shine, foil finish, surface appearance, centering, print lines, refractor effects, and other visual details may appear differently depending on lighting, photography, screen settings, device type, and display configuration.
All descriptions, prices, photos, and availability are subject to change at any time without notice before an order is accepted.
We reserve the right to discontinue any product, limit quantities, correct errors, remove listings, or limit sales to any person, geographic region, or jurisdiction on a case-by-case basis.
SECTION 3 - TRADING CARD CONDITION AND COLLECTIBLE VALUE
Raw trading cards are sold based on the condition stated in the listing and our review at the time of listing. Condition opinions may vary between sellers, buyers, collectors, and third-party grading companies.
Customers should review all listing photos, written descriptions, condition notes, card details, and product information before purchasing.
Unless expressly stated otherwise, raw trading cards are not professionally graded and are not guaranteed to receive any particular third-party grade.
BD Card Shop does not guarantee future grading outcomes, market values, resale values, investment returns, population report changes, auction results, price trends, or the future performance of any collectible product.
Any price comparisons, market references, or value-related statements are provided for general reference only and are not financial, investment, grading, or resale advice.
SECTION 4 - SEALED PRODUCTS
Sealed products are sold as sealed collectible products.
BD Card Shop does not guarantee the contents, odds, hits, autographs, relics, inserts, parallels, short prints, grades, centering, values, redemptions, pack sequencing, collation, or results inside any sealed pack, box, blaster, tin, case, mystery item, or sealed trading card product.
Opened sealed products cannot be returned.
Dissatisfaction with the contents of a sealed product, lack of a desired card, lack of a desired hit, expired redemption, manufacturer collation, manufacturer packaging issue, or market value of the contents is not a valid reason for return, refund, exchange, cancellation, or price adjustment.
SECTION 5 - ORDERS
When you place an order, you are making an offer to purchase. Your order is not accepted until BD Card Shop confirms acceptance and payment has been received and processed.
Please review your order carefully before submitting it. We may be unable to accommodate cancellation requests after an order is accepted.
We reserve the right to accept, decline, cancel, modify, or refuse any order for any reason, including suspected fraud, payment issues, incorrect pricing, inventory errors, listing errors, shipping restrictions, address issues, policy violations, marketplace conflicts, or other business reasons.
If we cancel an order after payment has been collected, the refund will be issued to the original payment method.
Your purchases are subject to return, refund, exchange, cancellation, damaged shipment, and lost package rules solely in accordance with our Return and Refund Policy and Shipping Policy.
SECTION 6 - PRICES, PROMOTIONS, AND BILLING
Prices, discounts, shipping charges, handling charges, taxes, promotions, and offers are subject to change without notice before an order is accepted.
The price charged will be the price in effect at the time the order is placed, unless the price resulted from an error, in which case BD Card Shop may cancel the order and refund the original payment method.
Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs, import duties, or other charges.
Prices on bdcardshop.com may differ from prices offered on marketplaces, social platforms, live sales, physical events, or third-party sales channels.
Once an order is placed, market price changes do not qualify for cancellation, return, refund, exchange, or price adjustment.
You agree to provide current, complete, and accurate purchase, payment, billing, shipping, and account information for all purchases. You agree to promptly update your account and information so we can complete transactions and contact you as needed.
You represent and warrant that any payment information you provide is true, correct, complete, authorized for your use, and that charges incurred by you will be honored by your payment provider.
SECTION 7 - FRAUD PREVENTION AND ORDER REVIEW
BD Card Shop may use fraud screening tools, Shopify fraud analysis, payment verification, address verification, identity verification, order review, delivery confirmation review, signature requirements, or other security steps before fulfilling an order.
Orders flagged as high risk may be delayed, canceled, refunded, or require additional verification.
We reserve the right to cancel or refuse orders that appear fraudulent, suspicious, abusive, inconsistent with normal customer purchasing behavior, connected to payment risk, connected to chargeback abuse, or otherwise risky to BD Card Shop.
SECTION 8 - SHIPPING AND DELIVERY
Customers are responsible for entering a correct and complete shipping address at checkout.
Shipping times are estimates only and are not guaranteed unless a shipping carrier expressly provides a guarantee.
BD Card Shop is not responsible for delays caused by shipping carriers, weather, incorrect addresses, forwarding issues, customs, delivery access problems, carrier scanning issues, postal interruptions, natural disasters, or events outside our control.
Once an order is transferred to the shipping carrier, title and risk of loss pass to the customer to the fullest extent permitted by law, subject to any rights or claims available under our Return and Refund Policy, Shipping Policy, and applicable law.
Lost packages and damaged shipments are handled under our Return and Refund Policy and Shipping Policy.
Envelope shipping is not insured and may carry additional delivery and condition-at-delivery risk caused by normal carrier handling while in transit. If envelope shipping is used, that risk is handled under our Shipping Policy and Return and Refund Policy.
BD Card Shop currently ships only within the United States. Orders requiring shipment outside the United States may be canceled and refunded to the original payment method.
SECTION 9 - RETURNS AND REFUNDS
Returns, refunds, exchanges, cancellations, damaged shipments, lost packages, and approved resolutions are governed by our Return and Refund Policy.
All sales are final unless an exception is approved under that policy.
Shipping and handling charges are always non-refundable once an item ships, unless BD Card Shop is at fault.
Approved refunds are always issued to the original payment method.
SECTION 10 - MARKETPLACE AND THIRD-PARTY SALES CHANNELS
BD Card Shop may sell through connected marketplaces, sales channels, apps, or third-party platforms.
Orders placed through a marketplace or third-party platform may also be subject to that platform’s rules, payment terms, return rules, shipping rules, buyer protection policies, seller obligations, and dispute process.
If there is a conflict between a marketplace’s required rules and BD Card Shop’s store policy for an order placed through that marketplace, the marketplace’s required rules may control for that order.
SECTION 11 - INTELLECTUAL PROPERTY
Our Services, including trademarks, store name, logos, branding, text, photos, graphics, product reviews, video, audio, layout, design, selection, and arrangement, are owned by BD Card Shop, its affiliates, licensors, service providers, or other rights holders and are protected by U.S. and foreign intellectual property laws.
These Terms allow you to use the Services for personal, lawful, non-commercial use only.
You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, scrape, extract, or transmit any material from the Services without prior written consent, except as permitted by law.
Nothing in these Terms grants you any license or ownership rights in BD Card Shop, Shopify, or third-party intellectual property.
Shopify’s name, logo, product and service names, designs, and slogans are trademarks of Shopify. All other names, logos, product names, service names, designs, and slogans are the trademarks of their respective owners.
SECTION 12 - OPTIONAL TOOLS AND THIRD-PARTY SERVICES
We may provide access to customer tools, apps, payment services, sales channels, analytics tools, shipping services, marketplace integrations, or other services offered by third parties.
These tools are provided “as is” and “as available.” We do not control all third-party tools and are not responsible for their availability, accuracy, performance, policies, or results.
Your use of optional third-party tools is at your own risk and discretion. You should review and approve the terms and policies of any third-party provider before using those tools.
We may offer new features, tools, apps, integrations, or resources in the future. Those features are also part of the Services and subject to these Terms.
SECTION 13 - THIRD-PARTY LINKS
The Services may contain links, embedded features, or materials from third-party websites or services.
We are not responsible for examining or evaluating third-party content, accuracy, websites, products, services, or policies.
If you leave our Services to access third-party sites, you do so at your own risk.
Complaints, claims, concerns, or questions regarding third-party products or services should be directed to the third party.
SECTION 14 - RELATIONSHIP WITH SHOPIFY
BD Card Shop is powered by Shopify, which enables us to provide the Services to you.
However, any sales and purchases made through our store are made directly with BD Card Shop.
By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sale between you and BD Card Shop, including any injury, damage, loss, dispute, return, refund, shipping issue, or claim resulting from purchased products or services.
You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with BD Card Shop.
SECTION 15 - PRIVACY POLICY
Personal information collected through the Services is subject to our Privacy Policy.
Because our store is hosted by Shopify, Shopify may collect and process personal information about your access to and use of the Services in order to provide and improve the Services.
Information you submit to the Services may be transmitted to and shared with Shopify and other third parties, including parties that may be located in other countries, as necessary to provide the Services.
By using the Services, you acknowledge that you have read our Privacy Policy and understand that Shopify and other third-party service providers may process information as part of operating the store.

You represent and warrant that you own or have all necessary rights to the content you submit, that you have disclosed any compensation or incentives connected to the submission, and that the content complies with these Terms.
We are not required to maintain feedback in confidence, pay compensation for feedback, or respond to feedback.
We may monitor, edit, or remove customer content that we determine is unlawful, offensive, threatening, defamatory, obscene, abusive, misleading, fraudulent, violates intellectual property rights, violates privacy rights, or otherwise violates these Terms.
You may not use a false email address, pretend to be someone else, mislead us or third parties about the origin of content, or submit malware, viruses, spam, or unlawful content.
SECTION 17 - ERRORS, INACCURACIES, AND OMISSIONS
Information on or in the Services may contain typographical errors, inaccuracies, or omissions related to product descriptions, photos, card details, condition, pricing, promotions, offers, shipping charges, transit times, availability, or other store content.
We reserve the right to correct errors, inaccuracies, or omissions, change or update information, remove listings, or cancel orders if any information is inaccurate at any time, including after an order has been submitted.
SECTION 18 - PROHIBITED USES
You may access and use the Services only for lawful purposes.
You may not use the Services, directly or indirectly:
- for any unlawful, fraudulent, abusive, or malicious purpose;
- to violate any applicable international, federal, state, provincial, or local law;
- to infringe or violate our intellectual property rights or the rights of others;
- to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or threaten any person;
- to transmit false or misleading information;
- to submit or transmit malware, viruses, malicious code, spam, phishing attempts, or other harmful content;
- to impersonate another person or entity;
- to engage in payment fraud, chargeback abuse, return fraud, package fraud, or address fraud;
- to interfere with, bypass, or circumvent security, fraud controls, account controls, access restrictions, robot exclusion headers, CAPTCHAs, or other protective measures;
- to reproduce, duplicate, copy, scrape, extract, sell, resell, or exploit any portion of the Services without written permission;
- to collect or track personal information of others;
- or to engage in conduct that restricts or interferes with anyone’s use or enjoyment of the Services or that may harm BD Card Shop, Shopify, our customers, or our service providers.
We reserve the right to suspend, disable, or terminate your account, cancel orders, or refuse service if we determine that you violated these Terms.
SECTION 19 - AGENTS, BOTS, SCRAPING, AND AUTOMATED ACCESS
This section applies if you use, allow, enable, or cause the deployment of an agent, bot, crawler, scraper, automated process, AI tool, or other software or service that accesses, uses, extracts, purchases from, or interacts with the Services.

Automated tools may not mimic human behavior, circumvent CAPTCHAs, avoid rate limits, bypass security measures, scrape product data or images, interfere with checkout, manipulate inventory availability, or place orders in a way that harms the Services or other customers.
We may use technical measures to limit, block, rate-limit, or control automated access.

We may terminate these Terms or your access to the Services, or any part of the Services, at any time and without notice in our sole discretion.
You remain liable for all amounts due up to and including the date of termination.
Sections that by their nature should survive termination will continue to apply, including sections on intellectual property, feedback, termination, warranty disclaimers, limitation of liability, indemnification, severability, waiver, entire agreement, assignment, governing law, privacy, and any unpaid obligations.

Any reliance you place on store information, market information, product data, price references, photos, descriptions, or third-party tools is at your own risk.
Except as expressly stated by BD Card Shop or required by law, the Services and all products offered through the Services are provided “as is” and “as available,” without warranties or conditions of any kind, whether express or implied, including implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
BD Card Shop does not guarantee that use of the Services will be uninterrupted, timely, secure, or error-free.
BD Card Shop does not guarantee future value, investment performance, grading results, resale results, pack odds, redemption validity, manufacturer collation, or specific contents of sealed products.
Some jurisdictions limit or do not allow certain warranty disclaimers, so some of the above may not apply to you.
SECTION 22 - LIMITATION OF LIABILITY
To the fullest extent permitted by law, BD Card Shop, our partners, owners, directors, officers, employees, affiliates, agents, contractors, service providers, licensors, Shopify, and Shopify’s affiliates will not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, consequential, or similar damages of any kind, including lost profits, lost revenue, lost savings, loss of data, replacement costs, lost resale opportunity, lost market value, grading outcomes, market changes, shipping delays, carrier issues, or other similar damages.
This limitation applies whether based in contract, tort, negligence, strict liability, statute, or otherwise, and applies to claims arising from your use of the Services, purchase of products through the Services, product information, errors or omissions, content, shipping, delivery, returns, refunds, third-party services, or any related matter, even if advised of the possibility of such damages.
To the fullest extent permitted by law, BD Card Shop’s total liability for any order will not exceed the amount paid for the item or order at issue.
SECTION 23 - INDEMNIFICATION
You agree to indemnify, defend, and hold harmless BD Card Shop, Shopify, our affiliates, partners, owners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, claims, costs, or expenses, including reasonable attorneys’ fees, arising out of or related to:
- your breach of these Terms or any policies incorporated by reference;
- your violation of any law or the rights of a third party;
- your access to or use of the Services;
- your misuse of products purchased from BD Card Shop;
- your fraud, chargeback abuse, return fraud, package fraud, or account misuse;
- or content, feedback, reviews, or information you submit.
We may control the defense and settlement of any claim, and you agree to cooperate by providing relevant information and documents.
SECTION 24 - SEVERABILITY
If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforceable to the fullest extent permitted by law, and any unenforceable portion will be deemed severed from these Terms.
The remaining provisions will continue in full force and effect.

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
These Terms of Service and any policies or operating rules posted by us on the website or in respect to the Services constitute the entire agreement and understanding between you and BD Card Shop and govern your use of the Services.
These Terms supersede any prior or contemporaneous agreements, communications, or proposals, whether oral or written, between you and BD Card Shop regarding the Services.
Any ambiguities in interpretation will not be construed against the drafting party.

You may not delegate, transfer, or assign these Terms or any of your rights or obligations under these Terms without our prior written consent. Any attempted assignment without consent is void.
We may transfer, assign, or delegate these Terms and our rights and obligations without your consent or notice.

These Terms of Service and any separate agreements under which we provide Services are governed by and construed in accordance with the laws of the State of Illinois, without regard to conflict of law principles, unless applicable law requires otherwise.
To the fullest extent permitted by law, you and BD Card Shop consent to venue and personal jurisdiction in the state and federal courts with jurisdiction over BD Card Shop’s principal place of business in Illinois.
